PLEASE READ THESE BOOKING CONDITIONS CAREFULLY

Your contract will be with Clouds Hill Writers

Definitions

"Customer" is the person who books a place on a Clouds Hill Writers course, subject to these Conditions and whose booking is accepted by Clouds Hill Writers.
“Guest” is a customer who attends a Clouds Hill Writers course at one of the Clouds Hill Writers venues.
“Clouds Hill Writers” is a trading name for Grace Dugdale.

How to book your place

Please complete the booking form, sign it and send it with the required amount. A deposit of £200 per person is required.  Until the deposit or full payment is received the booking is treated as provisional and will be held for a maximum of 7 days.  All deposits are non-refundable and non-transferable.  Full payment is due on bookings made less than 8 weeks before the course begins.

Payment and balance of fees

After paying the deposit you will receive a receipt and confirmation of your booking. This is also an invoice for the balance of the course fee which is due 8 weeks before the start of the course.  Please check this information carefully.

If payment is not received one month before the start of the course, Clouds Hill Writers reserves the right to cancel your reservation, in which case normal cancellation terms will apply.  Please notify us if you anticipate a delay in making your final payment.

Clouds Hill Writers will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

Cancellation

If it is necessary for you to cancel your booking please inform Clouds Hill Writers in writing as soon as possible. Cancellation is effective from the date of receiving your letter.  If cancellation is made less than 4 weeks before the start of the course, whether deliberately or by default, the balance of fees must be paid in full. This condition is accepted when the booking is confirmed. 

Programme details

Final details of the programme and itinerary will be sent to you approximately two weeks before the course commences.

Other changes

We regret that no reductions can be made in respect of late arrival, early departure or absence during any part of the course.

Acceptance

Clouds Hill Writers reserves the right to refuse any booking request without stating a reason.

Travel & cancellation insurance

If you are forced to cancel or curtail your course you are liable to payment of up to 100% of the course fees.  We recommend taking out any necessary travel and cancellation insurance.

Risk

Clouds Hill Writers  shall not be liable for any damage or injury caused to the Tennant in respect of the property or any amenity provided by Clouds Hill Writers or for any loss or damage to the personal belongings of the Tenant how so ever arising.

Personal Property

Clouds Hill Writers cannot accept responsibility for loss of or damage to guests’ personal belongings, such as baggage or money.  Please note that not all rooms in the venues can be locked and we advise against bringing items of value, such as expensive jewelry.  We recommend that you take out insurance cover prior to your visit and if you wish to bring a laptop computer to ensure that it is adequately insured.

Cancellation of courses

Clouds Hill Writers reserves the right to cancel any course without stating a reason.  In the case of cancellation, all deposits and any balances paid will be refunded in full. The decision to cancel will normally be taken and refunds made not less than a week before the start date.

Travel to and from the venue

The customer shall be responsible for travel to and from the venue and any costs incurred.  Clouds Hill Writers accepts no responsibility for travel arrangements or any loss arising from delays or problems with transportation. 

Conduct

Participation in a Clouds Hill Writers course relies on a level of tolerance and understanding of others and their creative work and we ask that you are thoughtful and respectful of the other guests. Clouds Hill Writers reserves the right to refuse a place and to exclude from a course any guest who, in the opinion of the Centre Directors, behaves in an abusive or disruptive manner or engages in any discriminatory conduct. No refund will be given if exclusion is made for these reasons.  The use of drugs or any other illegal substances is strictly prohibited whilst attending a Clouds Hill Writers course.  All venues are non-smoking

Severability

If any provision or any part of these Terms is deemed to be illegal void or unenforceable for any reason then such provision or part shall be deemed to be severed from the remaining provisions or parts, which shall remain in full force and effect.

Force Majeur

Clouds Hill Writers shall not be liable to the customer or be deemed to be in breach of contract by reason of any delay in performing, or any failure to perform any of its obligations if the delay or failure was due to any cause beyond its reasonable control

Variation

No variation to these Terms shall be binding unless agreed in writing between the authorised representatives Clouds Hill Writers and the Customer

Law

These Terms shall be construed according to the laws of England. Clouds Hill Writers and the customer submit to the non-exclusive jurisdiction of the English Courts.  Any disputes will be dealt with according to the law of England, regardless of course location.

The purpose of this statement is to set out how Clouds Hill Writers will use personal information that it may obtain from and about you. By registering as a user of the services provided by Clouds Hill Writers] and by using the Clouds Hill Writers web site generally, you agree to the following.

Clouds Hill Writers may inform you (by e-mail, telephone, text message, mail or otherwise) about products and services (including those of other companies and organisations) which we consider may be of interest to you. If you do not wish Clouds Hill Writers to use or share your information for marketing purposes, please tick the opt-out box provided when completing the booking form.
  • for the prevention and detection of fraud;
  • to administer any prize draws or competitions you may enter.
  • we may give information about you to the following, who may use it for the same purposes as set out above:
  • to employees and agents of Clouds Hill Writers to administer any accounts, products and services provided to you by Clouds Hill Writers now or in the future;
  • agents who profile your data so that we may tailor courses  we offer to your specific needs;
  • to other organisations for the administration of prize draws or competitions.

We may also disclose your information:

  • to anyone to whom we transfer or may transfer our rights and duties under our agreement with you;
  • if we have a duty to do so or if the law allows us to do so.

Clouds Hill Writers may supplement the information that you provide to us with information that we receive from third parties.

Clouds Hill Writers endeavours to take all reasonable steps to protect your personal information. However, we cannot guarantee the security of any data you disclose on-line. You accept the inherent security risks of providing information and dealing on-line over the Internet and will not hold us responsible for any breach of security unless this is due to our negligence or wilful default.

You have the right to see personal data (as defined in the Data Protection Act) that Clouds Hill Writers keeps about you, upon receipt of a written request and payment of a fee. If you are concerned that any of the information we hold on you is incorrect please contact us.

Please be aware that our site may link to other web sites which may be accessed through the Clouds Hill Writers site. We are not responsible for the data policies or procedures or the content of these linked web sites.

In the course of undertaking the activities specified in this privacy policy Clouds Hill Writers may transfer data outside the European Economic Area to countries which do not have data protection laws or to countries where your privacy and other fundamental rights may not be protected as extensively as in the United Kingdom.

How can I get my name removed from the Clouds Hill Writers mailing list?

If you want to be removed from our mailing list, please send an email to data@cloudshillwriters with the word 'remove' in the subject line. Please note that it may take up to 28 days to action your request.
